DRAFT v1.0 — For Attorney Review Prior to Publication
May 11, 2026
IMPORTANT NOTICE — READ FIRST
This document is a structured DRAFT prepared as a starting point for legal review. It is not a final legal document and must not be published, displayed on a website, or used as a basis for customer agreements until it has been reviewed, revised, and approved by a qualified attorney admitted in the United States with experience in:
-
International consumer protection law (EU, UK, US state-level)
-
Subscription billing & automatic renewal disclosure (California ARL, Vermont, Colorado, etc.)
-
Travel & concierge service contracts
-
E-commerce and distance selling regulations (EU Consumer Rights Directive)
-
Wyoming LLC operating agreements and consumer-facing disclosures
Areas requiring particularly careful attorney attention:
-
Elite Memberships valued at $30,000 USD or more should be governed by separate signed agreements rather than (or in addition to) standard click-through Terms.
-
Cancellation fee structures for travel packages involving private jet charter must align with the underlying jet operator’s cancellation terms (pass-through liability).
-
Document handling services have time-sensitive liability exposure; limitation of liability clauses must be customized.
-
EU consumers have non-waivable 14-day withdrawal rights for distance contracts; service exemptions must be properly invoked.
-
California auto-renewal disclosures (Business & Professions Code §17600 et seq.) require specific font sizes, placement, and acknowledgment.

Jet charter cancellation. Private jet, hotel, ground transfer, and any third-party luxury vendor costs follow the cancellation terms of the operator providing that service. These are passed through to the Client and are typically more restrictive (often non-refundable within 30 days of departure). The full operator terms will be provided in writing at the time of booking confirmation.
Reschedule option. A one-time reschedule to a date within 12 months may be offered at our sole discretion, subject to availability and re-quoting of third-party costs. Reschedule does not reset the cancellation fee schedule once invoked.
3.4 SOS Emergency Services
Applies to: Emergency Rush SOS ($500).
SOS services are non-refundable once payment is confirmed. The service consists of immediate response, situation assessment, and the delivery of an action plan within hours. Because the work begins immediately upon payment confirmation, refunds are not available.
If, in our reasonable judgment, no viable solution can be identified for the Client’s situation, a refund of 50% may be issued at our discretion.
3.5 Document Monitoring Subscription
Applies to: Document Monitoring ($75/month).
-
Billed monthly in advance.
-
The Client may cancel at any time through their account portal or by emailing us.
-
Cancellation takes effect at the end of the then-current billing period. No pro-rated refunds are issued for partial months.
-
If a paid Document Check is provided free of charge under the “third trip per year” benefit, the value of that complimentary check is forfeited upon cancellation.
3.6 Elite Memberships (Annual)
Applies to: Document Guard ($5,000/year), Full Service Elite ($10,000/year), No Worries S ($30,000/year), No Worries M ($50,000/year), No Worries L ($75,000/year), No Worries Global (from $120,000/year).
Cooling-off period. Within 14 calendar days of the Effective Date and provided no services have yet been rendered, the Client may cancel the membership for a full refund less a $250 administrative fee.
After the cooling-off period. Annual memberships are non-refundable once activated, except as required by applicable law. Services not yet used during the term are forfeited upon cancellation.
Pro-rated exit. For memberships of $30,000/year or more, we may at our sole discretion offer a pro-rated refund less services already rendered and a 15% early-termination fee. Any such accommodation will be confirmed in writing.
Auto-renewal. Elite memberships renew automatically on each anniversary of the Effective Date unless canceled in writing at least 30 days before the renewal date. See Section 7.
High-value memberships. Elite memberships at $30,000/year or more are typically governed by an individually signed Member Agreement that supplements this Policy. Where conflicts arise, the signed Member Agreement controls.
4. CANCELLATION BY THE CLIENT
To cancel any booking or subscription:
-
Send written notice to paws@privepawtravel.com from the email address associated with your account.
-
Include the booking reference number, the service or membership to be canceled, and the date the request is being submitted.
-
We will confirm receipt within one Business Day and process the cancellation in accordance with this Policy.
Cancellations submitted outside of Business Days are deemed effective on the next Business Day. Cancellation fees are calculated based on the time of effective receipt.
5. CANCELLATION BY PRIVÉ PAW TRAVEL
We reserve the right to cancel or refuse to fulfill any booking in the following circumstances:
-
The Client provides false, incomplete, or misleading information, including with respect to the dog’s health, vaccination status, breed, behavior, or any document-related matter.
-
The Client engages in abusive, threatening, or harassing conduct toward our staff or partners.
-
Required documents, vaccinations, or permits cannot lawfully be obtained for the proposed itinerary.
-
A third-party provider essential to the booking (e.g., jet operator, hotel, airline) cancels, withdraws, or becomes unavailable.
-
We determine, in our reasonable judgment, that fulfilling the booking would create a material safety risk to the dog, the Client, our staff, or a third party.
-
Force majeure (see Section 10).
If we cancel for reason (1), (2), or (3) and the cause is attributable to the Client, no refund is owed. If we cancel for reason (4), (5), or (6), we will refund all amounts paid less any non-recoverable third-party costs already disbursed on the Client’s behalf.
6. REFUND POLICY
Approved refunds are issued to the original payment method used for the purchase and typically appear within five to ten Business Days, depending on the processor and the Client’s bank.
We do not issue refunds in cash, by check, or in any cryptocurrency.
We do not issue partial refunds for services already substantially performed (for example, where document research has been completed but the journey has not yet commenced).
Currency conversions, foreign-exchange spreads, and bank fees imposed by the Client’s payment institution are not reimbursable.
Where local law mandates a more favorable refund right than this Policy provides, the more favorable right will apply.
7. AUTO-RENEWAL SUBSCRIPTIONS
Document Monitoring and all Elite Memberships renew automatically until canceled.
At the time of purchase, we present in clear language:
-
That the subscription will renew automatically.
-
The renewal frequency (monthly for Document Monitoring; annually for Elite Memberships).
-
The renewal price (which equals the then-current published rate).
-
The method to cancel (see Section 4).
Before renewal, we send a reminder email to the address on file at least 30 days prior to the renewal date for annual memberships and at least 7 days prior for monthly subscriptions.
For California residents, additional notice and acknowledgment procedures are followed as required by California Business and Professions Code §17600 et seq.
If the Client believes a renewal was charged in error or without adequate disclosure, please contact us immediately at paws@privepawtravel.com.
8. EU & UK CONSUMER RIGHTS
For Clients ordinarily resident in the European Union or the United Kingdom and purchasing services as consumers (not in a business capacity), the following additional rights apply and are not waived by this Policy:
Right of withdrawal (14 days). Under the EU Consumer Rights Directive 2011/83/EU (and the UK equivalent), consumers have the right to withdraw from a distance contract within 14 calendar days of conclusion, without giving reasons.
Loss of withdrawal right. This right is lost if the Client expressly requests that we begin performing the service before the 14-day period ends and acknowledges that the right of withdrawal is lost once the service is fully performed.
For services tied to specific dates (private jet charter, hotel stays, transport on a specific date), the right of withdrawal does not apply under Article 16(l) of the Directive.
How to withdraw. Send an unambiguous statement to paws@privepawtravel.com.
Refund timing. Where withdrawal is validly exercised, we refund all amounts received within 14 days, less amounts proportionate to services already provided at the Client’s request.
9. FORCE MAJEURE
Neither party is liable for failure to perform any obligation under a booking to the extent that performance is prevented or materially delayed by events beyond reasonable control, including: acts of God, war, terrorism, civil unrest, government action, pandemic, epidemic, public health emergency, border closure, embargo, strike, transport disruption, airspace closure, severe weather, natural disaster, or failure of essential third-party infrastructure.
In a force majeure event:
-
The affected obligation is suspended for the duration of the event.
-
We will use commercially reasonable efforts to reschedule or substitute the service.
-
If performance remains impossible 30 days after the event begins, either party may terminate the booking, in which case we refund amounts paid less non-recoverable third-party costs.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
Our aggregate liability arising out of or in connection with any booking, whether in contract, tort (including negligence), strict liability, or otherwise, is limited to the amount actually paid by the Client to Privé Paw Travel for the specific booking giving rise to the claim, during the 12 months preceding the event.
We are not liable for:
-
Indirect, incidental, special, consequential, exemplary, or punitive damages.
-
Loss of profits, revenue, business, goodwill, opportunity, or data.
-
Acts, omissions, delays, or failures of third-party providers (airlines, jet operators, hotels, transport, veterinary clinics, government agencies, embassies, courier services), notwithstanding our reasonable efforts in selecting and engaging them.
-
Delays, denials, or refusals issued by border authorities, customs, or any government body.
-
Loss, injury, illness, escape, or death of the dog while in the care of any third party.
-
Inability to travel due to the dog’s health condition, behavioral state, breed restriction, or any failure to meet a destination’s published entry requirements where such requirements were verifiable in advance.
Nothing in this Section limits liability for: (a) death or personal injury caused by our gross negligence or willful misconduct; (b) fraud; or (c) any other liability that cannot be limited or excluded by applicable law.
11. DISPUTE RESOLUTION & GOVERNING LAW
Informal resolution first. Before initiating any formal proceeding, both parties agree to attempt in good faith to resolve any dispute through written communication, beginning with notice to paws@privepawtravel.com. We will respond within 14 Business Days.
Governing law. This Policy and any non-contractual obligations arising from or connected with it are governed by the laws of the State of Wyoming, United States, without reference to its conflict of laws principles. Where mandatory consumer protection laws of the Client’s country of residence provide additional non-waivable rights, those rights apply.
Forum. Subject to the consumer protection caveat above, the courts located in the State of Wyoming have exclusive jurisdiction.
No class actions. To the extent permitted by applicable law, each party waives any right to participate in a class, collective, or representative action.
EU & UK consumers. Nothing in this Section deprives EU or UK consumers of their right to bring proceedings in the courts of their country of residence or to invoke the consumer protections of that country.
12. CHANGES TO THIS POLICY
We may update this Policy from time to time. The version in effect at the time of a booking governs that booking. Material changes affecting active subscriptions or memberships will be communicated to the email address on file at least 30 days before they take effect, and will apply only to renewals occurring after the notice period.
